Right of withdrawal - complaints

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, without prejudice to the cases of exclusion envisaged on subsequent points. The refund will take place using the same payment method used by the customer, unless he expressly requested a different method. In this eventuality, the product will be made available to the Customer for its return simultaneously by canceling the request for withdrawal.

The right of withdrawal decays totally, due to the lack of the essential condition of integrity of the property (packaging and/or its content), in cases where Sicilus ascertain:

  • The lack of the external package and/or the envelope containing the product purchased;
  • Damage to the product for reasons other than its transport;

In the case of forfeiture of the right of withdrawal, Sicilus will return the purchased asset to the sender, charged the shipping costs to the same.

If the customer wants to exercise the right of withdrawal for goods not yet received due to delays in delivery dependent on the carrier, the refund will be made within 14 days from the moment the carrier is ready to return the delivery to the sender. In case of loss of the package, the 14 -day deadline to operate the refund, will start from the 30th day following the starting one of the purchased goods.

In addition to the cases indicated above (non -consumer customer and/or requesting the invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:

  • Order of tailor -made or clearly customized products;
  • Order of products that risk deteriorating or expires quickly;
  • Order of sealed products that do not lend themselves to being returned for hygienic reasons or connected to the protection of health and/or that have been opened after delivery.

With reference to the cases of exclusion of the withdrawal listed above, in particular, it is informed and accepts that among the products that "risk deteriorating or expires quickly" are all food products (engraved wines, alcohol and drinks), as the characteristics and qualities of these types of products are subject to alteration also as a consequence of an unspeakable conservation. Therefore, for hygiene and customer protection reasons, the right of withdrawal is applicable only for the products purchased on the site that can be returned to Sicilus. and put back on the market without dangers for the health of consumers (such as books, gadgets, kitchen utensils, etc.). If the Customer equally intends to make assets subject to exclusion from the right of withdrawal (pursuant to art. 59 lett.
